These Terms and Conditions (“Terms”) govern your access to and use of the websites, online stores, booking pages, forms, content, products, services, and other digital properties operated by CALACAS LLC (“CALACAS,” “Company,” “we,” “our,” or “us”).

By accessing our website, creating an account, booking an appointment, purchasing a product or service, submitting information, or otherwise using our Site or services, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the Site or purchase or book our products or services.

CALACAS LLC reserves the right to update or modify these Terms at any time. Updated Terms become effective when posted to the Site unless otherwise stated. Your continued use of the Site following an update constitutes acceptance of the revised Terms.

1. ABOUT CALACAS LLC

CALACAS LLC provides and/or facilitates products and services that may include, depending on location and availability:

• Hair systems and hair replacement products

• Hair system consultations

• Hair system installation and customization

• Hair system maintenance and reinstallation

• Haircuts and grooming services

• Hair and scalp appearance services

• Scalp micropigmentation (“SMP”) services

• Hair-loss-related consultations

• Professional grooming products

• Hair system care products and accessories

• Apparel and merchandise

• Educational or professional training

• Other related products and services offered by CALACAS LLC

Specific services, providers, prices, availability, policies, and locations may vary.

2. INTELLECTUAL PROPERTY RIGHTS

Our Limited License to You

The Site and the materials made available through it—including text, photographs, videos, graphics, logos, icons, designs, educational materials, service descriptions, product descriptions, branding, downloads, and other content—are owned by or licensed to CALACAS LLC and may be protected by copyright, trademark, and other intellectual property laws.

Unless we provide written authorization, you may not copy, reproduce, republish, modify, distribute, sell, license, display, transmit, create derivative works from, commercially exploit, or otherwise use CALACAS LLC content except for your personal and lawful use of the Site.

You may download or print reasonable portions of the Site for personal, non-commercial use provided all copyright, trademark, and proprietary notices remain intact.

Nothing contained on the Site grants you ownership of or a license to use the CALACAS, CALACAS LLC, CALACAS logos, designs, service names, artwork, or other intellectual property except as expressly authorized by us in writing.

3. CONTENT YOU SUBMIT TO CALACAS

When you voluntarily submit content to CALACAS LLC—including reviews, testimonials, comments, photographs, videos, before-and-after images, social media content, or other materials—you represent that you either own the content or have permission to submit it.

Where you separately authorize CALACAS LLC to use photographs, videos, testimonials, before-and-after content, or other identifiable promotional material, such use may also be subject to a separate media release, consent form, model release, or other written authorization.

Nothing in these Terms eliminates any consent that may otherwise be required by applicable law for the use of identifiable client photographs, videos, or personal information.

4. APPOINTMENTS AND BOOKINGS

Appointments may be scheduled through our website, booking platforms, telephone, text message, in person, or through other approved CALACAS LLC booking methods.

Appointment availability is not guaranteed until the booking is confirmed.

Certain services may require:

• A consultation

• A deposit

• Full or partial prepayment

• Client forms

• Identification

• A service agreement

• A consent or waiver

• Measurements, photographs, or other information

• Advance ordering of a customized product or hair system

CALACAS LLC reserves the right to refuse, reschedule, or cancel an appointment when reasonably necessary, including for safety concerns, provider availability, inaccurate booking information, inappropriate conduct, or failure to comply with applicable policies.

5. DEPOSITS AND PREPAYMENTS

Certain appointments, hair systems, customized products, training programs, or services may require a deposit or prepayment.

Unless otherwise stated at the time of purchase, a deposit is applied toward the applicable product or service.

Deposits associated with customized, special-order, prepared, or individually allocated products may become non-refundable once CALACAS LLC has placed an order, allocated inventory, customized the item, or otherwise incurred costs specifically for that customer.

Any specific cancellation, rescheduling, deposit, or refund terms displayed during booking or purchase will apply to that transaction.

6. HAIR SYSTEMS AND CUSTOMIZED PRODUCTS

Hair systems may vary in:

• Base construction

• Hair type

• Density

• Color

• Texture

• Length

• Curl pattern

• Hairline

• Size

• Durability

• Expected lifespan

Photos displayed online are examples and may not represent the exact appearance of every system.

The appearance and longevity of a hair system can depend on factors including maintenance, lifestyle, scalp condition, adhesives, cleaning practices, environmental exposure, frequency of wear, and home care.

Any estimated lifespan provided for a hair system is an estimate and is not a guarantee that the system will last for a particular period.

Once a hair system has been cut, colored, altered, bonded, installed, customized, worn, or otherwise modified for a customer, it may not be eligible for return or exchange except where required by law or where CALACAS LLC expressly agrees otherwise.

7. HAIR SYSTEM INSTALLATION AND MAINTENANCE

Hair system installation may involve preparation of the client's existing hair or scalp, customization of the system, adhesives or tapes, cutting, blending, styling, and other techniques.

Maintenance requirements vary by client and system.

Clients are responsible for following the aftercare and maintenance instructions provided by their CALACAS professional.

Failure to follow proper care instructions may affect appearance, adhesion, comfort, and the lifespan of the hair system.

Maintenance appointments, replacement systems, adhesives, aftercare products, haircuts, color services, and other services are not automatically included with an initial installation unless expressly stated in the purchased package.

8. APPEARANCE AND RESULTS

CALACAS LLC strives to provide professional products and services; however, individual results vary.

Hair type, scalp characteristics, skin characteristics, existing hair, lifestyle, healing, maintenance, home care, product selection, and other individual factors may affect results.

Photographs, videos, testimonials, before-and-after images, demonstrations, and examples shown on the Site or social media represent individual experiences and are not guarantees that another client will receive identical results.

9. SMP AND OTHER APPEARANCE SERVICES

Where scalp micropigmentation or another specialized appearance service is offered, clients may be required to complete separate consultation forms, disclosures, consent forms, health questionnaires, aftercare acknowledgments, and service agreements.

Those documents are incorporated into the applicable service relationship and may contain additional requirements specific to that service.

SMP is a cosmetic appearance service and should not be represented as causing new hair growth.

10. HAIR-LOSS INFORMATION

Information provided by CALACAS LLC concerning hair loss, hair systems, scalp appearance, grooming, or available hair-restoration options is intended for general informational purposes.

Unless expressly provided by an appropriately licensed medical professional acting within their scope of practice, CALACAS LLC does not diagnose medical conditions or provide medical treatment.

When appropriate, clients may be encouraged to consult a physician or other licensed healthcare professional regarding medical causes of hair loss or medical treatment options.

11. PRODUCTS AND ONLINE COMMERCE

The Site may allow customers to purchase products and services directly from CALACAS LLC or through third-party payment, booking, fulfillment, or e-commerce providers.

Product availability, pricing, descriptions, and specifications may change without notice.

We make reasonable efforts to accurately display products, including colors, textures, dimensions, and appearance. However, differences in screens, photography, manufacturing, natural hair characteristics, and other factors may cause actual products to vary from images.

We reserve the right to:

• Limit quantities

• Correct pricing or description errors

• Cancel fraudulent or suspicious orders

• Refuse transactions when permitted by law

• Discontinue products

• Substitute packaging where the underlying product is materially unchanged

If an order is canceled after payment has been collected and no product or service has been provided, any refund due will be processed in accordance with applicable law and the payment provider's processing procedures.

12. THIRD-PARTY PRODUCTS AND SERVICES

CALACAS LLC may work with or provide links to manufacturers, suppliers, booking providers, payment processors, fulfillment providers, financing providers, healthcare providers, hair restoration providers, or other independent third parties.

A link, referral, or business relationship does not necessarily mean that CALACAS LLC controls the third party.

Third parties may maintain their own terms, warranties, privacy policies, refund policies, and business practices.

To the extent permitted by law, CALACAS LLC is not responsible for the independent acts, omissions, products, services, policies, or representations of third parties that are not under CALACAS LLC's control.

13. PRICING

Prices displayed on the Site are subject to change without notice.

The price applicable to a transaction is generally the price confirmed when the customer completes the applicable purchase or booking, subject to correction of obvious errors.

Taxes, shipping, customization, maintenance, replacement products, add-ons, or other charges may apply where disclosed.

Promotional pricing, introductory pricing, discounts, coupons, or limited-time offers may be subject to separate eligibility requirements and expiration dates.

14. PAYMENTS

You agree to provide current, complete, and accurate billing and payment information.

You represent that you are authorized to use any payment method submitted for a purchase.

CALACAS LLC may use third-party payment processors. Your payment information may therefore also be subject to the payment processor's terms and privacy practices.

If payment is declined, reversed, disputed, or otherwise unsuccessful, CALACAS LLC may suspend delivery of the applicable product, appointment, service, training, or account access until the payment issue is resolved.

15. REFUND POLICY

Refund eligibility depends on the specific product or service purchased.

Products or services that have already been performed, consumed, customized, installed, altered, cut, colored, worn, downloaded, or specially ordered may not be refundable except where required by applicable law.

Any specific refund policy presented at checkout, during booking, in a service agreement, or in connection with a particular promotion, event, training program, product, or service becomes part of the terms governing that transaction.

Nothing in these Terms limits any non-waivable rights available to consumers under applicable law.

16. CANCELLATIONS, RESCHEDULING AND NO-SHOWS

Appointments may be subject to cancellation, rescheduling, late-arrival, and no-show policies.

Those policies may vary depending on the service, provider, location, booking platform, or amount of preparation required.

Where a cancellation or no-show policy is displayed during booking, you agree to that policy by completing the reservation.

Late arrival may result in a shortened appointment, rescheduling, cancellation, or loss of a deposit when permitted under the applicable booking policy.

17. TRAINING AND EDUCATIONAL PROGRAMS

If CALACAS LLC offers professional training, demonstrations, educational programs, courses, workshops, certifications, or instructional materials, participation does not guarantee employment, income, clients, business success, licensing, certification by a governmental authority, or any particular financial result.

Participants are responsible for determining and complying with licensing, professional, health, safety, and regulatory requirements applicable to their own activities.

Training materials provided by CALACAS LLC may constitute proprietary intellectual property and may not be copied, resold, distributed, uploaded, reproduced, or used to create competing educational materials without written authorization.

18. USER ACCOUNTS AND REGISTRATION

Certain features may require you to create an account.

You agree to provide accurate, current, and complete information and to update that information when necessary.

You are responsible for maintaining the confidentiality of your username, password, and account credentials.

You are responsible for activity occurring through your account unless otherwise required by law.

Please notify CALACAS LLC promptly if you believe your account or credentials have been accessed without authorization.

19. ACCEPTABLE USE

You may not use the Site to:

• Violate applicable law

• Impersonate another person or business

• Submit false or fraudulent information

• Attempt unauthorized access to accounts, systems, or networks

• Introduce viruses, malware, or harmful code

• Interfere with the operation or security of the Site

• Infringe copyrights, trademarks, privacy rights, publicity rights, or other rights

• Harass, threaten, abuse, or defame others

• Scrape or collect personal information without authorization

• Use automated systems to interfere with or improperly access the Site

• Engage in fraudulent transactions

• Reproduce or commercially exploit CALACAS LLC content without authorization

CALACAS LLC may restrict or terminate access when we reasonably believe these Terms have been violated.

CALACAS LLC does not necessarily own, operate, endorse, or control those websites.

Your use of a third-party website is subject to that third party's terms, policies, and practices.

21. DISCLAIMERS

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

CALACAS LLC DOES NOT GUARANTEE THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT GUARANTEE THAT ALL INFORMATION ON THE SITE WILL ALWAYS BE COMPLETE, CURRENT, OR FREE FROM TYPOGRAPHICAL OR TECHNICAL ERRORS.

NOTHING IN THIS SECTION EXCLUDES WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.

22. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CALACAS LLC AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE.

THE FOREGOING LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

NOTHING IN THESE TERMS IS INTENDED TO LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

23. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless CALACAS LLC and its affiliates, owners, members, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights.

24. TERMINATION

CALACAS LLC may suspend or terminate access to the Site or an account where reasonably necessary due to fraud, misuse, security concerns, violation of these Terms, or unlawful activity.

Provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and other provisions that by their nature should survive termination will remain effective following termination.

25. COPYRIGHT AND DMCA

CALACAS LLC respects intellectual property rights.

If you believe content appearing on a CALACAS LLC website infringes your copyright, you may submit a written notice identifying:

1 The copyrighted work you believe has been infringed;

2 The allegedly infringing material and its location;

3 Your contact information;

4 A statement that you have a good-faith belief that the disputed use is not authorized;

5 A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and

6 Your physical or electronic signature.

26. PRIVACY

Your use of the Site is also subject to the CALACAS LLC Privacy Policy.

Please review the Privacy Policy for information regarding how CALACAS LLC collects, uses, stores, and discloses personal information.

27. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.

To the extent permitted by applicable law, disputes arising from these Terms or use of the Site shall be handled in the appropriate courts located in Arizona, subject to any additional dispute-resolution agreement entered into between CALACAS LLC and the customer.

28. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

29. NO WAIVER

Failure by CALACAS LLC to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

30. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any applicable booking policy, purchase terms, consent form, service agreement, training agreement, or other terms specifically presented in connection with a product or service, constitute the applicable agreement between you and CALACAS LLC regarding use of the Site and the applicable transaction.

31. CHANGES TO THESE TERMS

CALACAS LLC may revise these Terms from time to time.

When changes are made, the revised version will be posted to the Site with an updated “Last Updated” date.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
